About these terms
These terms are an agreement between you and Launchific LLC (“we”) for Pulsida and this website. By buying a Pulsida license or using Pulsida, you accept them. Please read the dispute resolution section: it requires individual arbitration and waives class actions, unless you opt out.
How you buy a license
Pulsida is made and licensed by Launchific LLC. Licenses are sold through Polar, which acts as the merchant of record: when you buy a license, Polar is the seller of that purchase, and Polar’s Buyer Terms also apply to it.
Licensed, not sold
Pulsida itself is licensed to you, not sold: you get the right to use it, and Launchific LLC keeps ownership of the software. Your license is personal and non-transferable, and lets you use Pulsida on up to three Macs at a time, for as long as you follow these terms.
What you may not do
Don’t share, resell or publish your license key. Don’t copy, modify or redistribute Pulsida, reverse engineer it except where the law allows, or work around its licensing. Don’t use Pulsida to break the law.
Payment and taxes
A Pulsida license is a one-time purchase. Polar processes the payment, charges any sales tax or VAT that applies, and sends your receipt.
Refunds
Purchases are final. We give refunds only where the law requires one, or where Polar’s Buyer Terms provide for one. Refunds are issued through Polar. Nothing here limits the refund rights you have under the law where you live.
Updates
We may release updates to improve Pulsida or keep it working with new versions of macOS, and features may change over time. Pulsida checks for updates and offers to install them, and you can turn this off.
Using closed-lid mode
Closed-lid mode keeps your Mac awake with the lid closed. Use it on a desk or another open surface, never in a bag. Pulsida switches it off at low battery or critical heat, but you’re responsible for where and how you use your Mac.
Ownership
Pulsida, its design and its name belong to Launchific LLC. These terms don’t give you any rights to our trademarks.
Support
We provide support for Pulsida by email. Polar handles payments, receipts and the customer portal.
Third-party components
Pulsida includes open-source software, which is used under its own licenses. Those licenses apply to those components.
Export rules
You may not use or export Pulsida in violation of U.S. export laws or sanctions, including in embargoed countries or if you’re on a restricted-party list.
No warranty
Pulsida is provided as is and as available. We work hard to make it reliable, but to the extent the law allows, we make no warranties that it will be free of errors, uninterrupted or compatible with every future version of macOS.
Limitation of liability
To the extent the law allows, Launchific LLC isn’t liable for indirect, incidental, special or consequential damages, or for lost data or profits. Our total liability for any claim about Pulsida is limited to the amount you paid for it. Nothing in these terms limits rights you have under consumer law.
Indemnity
If your misuse of Pulsida or a breach of these terms leads to a claim against us, you agree to cover the costs it causes, to the extent the law allows.
Ending your license
You can stop using Pulsida at any time. If you seriously break these terms, we may end your license. Sections that by their nature should continue, such as ownership, limitation of liability and dispute resolution, still apply afterwards.
Who can use Pulsida
You must be at least 13, or the minimum age of digital consent in your country if that’s higher. If you’re under 18, a parent or guardian should agree to these terms with you.
Governing law
These terms are governed by the laws of the State of Wyoming, USA. Any dispute that isn’t settled in arbitration goes to the state or federal courts in Wyoming. This doesn’t take away consumer protections you have where you live.
Dispute resolution
If you have a problem, write to us first, and we’ll try to resolve it informally within 60 days. If we can’t, the dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Class actions and class arbitrations aren’t allowed. Either of us may bring a claim in small claims court instead. You can opt out of arbitration by emailing us within 30 days of buying Pulsida. Where the law allows, claims must be brought within one year.
Events outside our control
We aren’t responsible for delays or failures caused by events beyond our reasonable control, such as outages, natural disasters or changes to macOS.
General
If any part of these terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver of it. You may not transfer these terms; we may transfer them as part of a business transfer. These terms, together with Polar’s Buyer Terms for your purchase, are the whole agreement between us about Pulsida.
Changes to these terms
We may update these terms. If a change is significant, we’ll say so on this page before it takes effect. Continuing to use Pulsida after a change means you accept it.
